- "Website" — the website accessible at mestikades and its associated pages.
- "User", "you" — any person who visits the website or submits an enquiry.
- "Services" — the legal consultation and advisory services offered by the firm as described on the website.
- "Engagement" — a formal instruction given to the firm, confirmed in a separate client engagement letter.
- "Agreement" — these Terms and Conditions, together with any engagement letter.
2. Acceptance of Terms
By using this website, submitting an enquiry, or engaging the firm's services, you agree to be bound by these terms. If you do not agree, please do not use this website.
Formal engagement of the firm's services requires a signed engagement letter, which constitutes a separate agreement. These terms govern use of the website and initial enquiries.
You must be at least 18 years of age to use this website or to engage the firm's services.
3. Website Use
This website is provided for informational purposes and to facilitate contact with the firm. The content of this website does not constitute legal advice. Receiving information from this website does not create a solicitor-client relationship.
You may not:
- Use the website for any unlawful purpose
- Attempt to gain unauthorised access to any part of the website or its systems
- Use the website to transmit harmful, misleading, or offensive material
- Reproduce or distribute content from this website without the firm's written permission
4. Services
The firm offers three primary services: the Reflective Pre-Filing Session, the Syariah and Civil Coordination Advisory, and the Long-Form Family Affairs Plan. The scope and terms of each service are described on the website and, for formal engagements, confirmed in a client engagement letter.
Services are available to clients in Malaysia. Geographic restrictions may apply to specific court-related matters depending on the relevant jurisdiction.
The firm reserves the right to decline an enquiry or engagement at its discretion, including where a conflict of interest exists.
5. Enquiries and Engagement
Submitting an enquiry through this website does not create a solicitor-client relationship. A solicitor-client relationship is only established upon the execution of a client engagement letter.
Information shared via the website enquiry form before a formal engagement is established is treated with discretion but is not protected by solicitor-client privilege until an engagement letter has been signed.
6. Fees and Payment
The fees for each service are displayed on the website in Malaysian Ringgit (RM). These fees cover the firm's professional engagement as described. Disbursements (court fees, third-party charges, document retrieval costs) are not included in the stated fees and will be itemised and communicated to the client before they are incurred.
Payment terms are set out in the client engagement letter. The firm does not accept payment in advance through this website.
The firm's refund position on each service is as follows: the Pre-Filing Session fee is payable on attendance; the advisory and plan fees are subject to the terms set out in the engagement letter.
7. Intellectual Property
All content on this website — including text, design, and structure — is the intellectual property of Mestika Damai. You may view and print content for personal, non-commercial use. Any other reproduction, distribution, or adaptation requires the firm's prior written consent.
8. Disclaimers
The information on this website is provided in good faith and for general informational purposes only. It does not constitute legal advice for any specific situation. Laws and court practices change; the firm makes no representation that the information on this website is current, complete, or applicable to your circumstances.
The firm does not represent or warrant specific outcomes from any legal engagement. Family law matters are inherently variable, and results depend on the facts of each case.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, the firm's liability arising from use of this website is limited to direct losses caused by our negligence. We are not liable for indirect, consequential, or incidental losses arising from the use of, or inability to use, this website.
Nothing in these terms limits liability for fraud, death, or personal injury caused by the firm's negligence.
10. Termination
Either party may terminate a formal engagement in accordance with the terms set out in the engagement letter. The firm may suspend access to the website or decline further enquiries at any time without notice.
Upon termination of an engagement, sections of these terms relating to intellectual property, disclaimers, and dispute resolution continue to apply.
11. Governing Law and Dispute Resolution
These terms are governed by the laws of Malaysia. Any dispute arising from the use of this website or an engagement with the firm will be subject to the exclusive jurisdiction of the courts of Malaysia.
The firm encourages clients to raise any concerns directly with us in the first instance. We will make reasonable efforts to resolve disputes informally before any formal process is invoked.
12. Changes to These Terms
We may update these terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of this website following an update constitutes acceptance of the revised terms.
